These Terms of Use (“Terms”) govern your access to and use of the Hypein mobile and web application, dashboard, websites, and related services (collectively, the “Service”), operated by Hypebox Media SARL (“Hypebox,” “we,” “us,” “our”).
By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2) Eligibility & Account Registration
You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use the Service.
You agree to:

Notify us promptly of unauthorized access.
You are responsible for all activity under your account.
3) The Service
The Service provides tools such as creator discovery, campaign planning, tracking, analytics, reporting, and related workflow features. Features may change over time. We may add, remove, or modify features to improve the Service or comply with legal/technical requirements.
4) Subscriptions, Billing & Taxes
If you purchase a paid plan:
Fees are billed in advance on a recurring basis unless canceled.
Taxes may apply depending on your location.
Unless required by law, payments are non-refundable and there are no refunds for partial billing periods.
If payment fails, we may suspend or limit access until payment is resolved.
5) Acceptable Use
You agree not to:
Use the Service for unlawful, harmful, abusive, deceptive, or fraudulent purposes.
Attempt to reverse engineer, disrupt, or overload the Service.
Circumvent rate limits, access controls, or security measures.
Use the Service to violate any third-party rights (privacy, intellectual property, contractual rights).
Use the Service to collect or process sensitive data in ways prohibited by law.
We may suspend or terminate your access if we reasonably believe you breached these Terms.
6) Public Web Data / “Scraped Data” (Exclusive Section)
This section is a core part of these Terms.
6.1 Definitions
“Public Web Data” means data that is publicly accessible on websites or social platforms (e.g., public creator profiles, public posts, public engagement metrics, public-facing URLs).
“Scraped Data” means Public Web Data that is collected or retrieved by the Service (directly or via our infrastructure/vendors) and then displayed, analyzed, or stored as part of the Service.
6.2 What We Collect (Public Only)
The Service is designed to collect and process Public Web Data for analytics, discovery, monitoring, and reporting.
We do not intend to:
bypass paywalls,
break authentication or security controls,
access non-public/private areas,
or collect data that is not publicly accessible without lawful authorization.
This principle aligns with how major web-data platforms describe lawful extraction as limited to publicly accessible sources and/or sources you are authorized to access.
6.3 Your Responsibility (Critical)
You are solely responsible for ensuring that your use of the Service, including any scraping/collection features you enable, complies with:
applicable laws and regulations,
platform/website terms and policies,
and any third-party rights.
This mirrors common industry positioning that customers must use web-data services only in lawful, authorized ways and in line with acceptable use rules.
6.4 Prohibited Uses (Scraped Data)
You may not use the Service (or Scraped Data) to:
violate privacy laws (e.g., unlawful profiling or tracking),
collect sensitive personal data where prohibited,
harass, stalk, defame, discriminate, or target individuals,
support illegal, abusive, or deceptive activities,
or breach intellectual property or database rights.
We may restrict features, block targets, or suspend accounts to enforce these Terms and protect the Service.
6.5 Accuracy & “As-Is” Nature of Public Data
Public Web Data can change frequently, be incomplete, or be inaccurate. We do not guarantee accuracy, completeness, or timeliness of Scraped Data or analytics outputs. You should independently verify critical information before acting on it.
6.6 Rights Requests / Takedown (Creators & Third Parties)
If you are a creator or rights holder and believe the Service displays inaccurate public information, or you have a lawful request related to your data:
contact us at business@hypebox.agency with sufficient details (profile URL, issue description, proof of identity/rights when applicable).
We will review requests and take appropriate action where required by law.
6.7 Third-Party Infrastructure (Apify / Bright Data and Similar)
To operate the Service, we may use reputable third-party providers for web-data automation, routing, proxies, and related infrastructure (for example, Apify and Bright Data).
These providers generally require customers to comply with law and their acceptable use policies, and they emphasize responsible public-data collection practices.
Important: Even if we use third-party infrastructure, you remain responsible for ensuring your specific use case is lawful and compliant.
7) User Content & Inputs
You may upload or input data such as campaign briefs, creator lists, notes, budgets, and internal performance tracking (“User Content”).
You retain ownership of User Content. You grant us a worldwide, non-exclusive license to host, process, and display User Content solely to operate the Service and provide features you use.
You represent that you have all necessary rights to provide User Content and that it does not violate any law or third-party rights.
8) Intellectual Property
We own all rights in the Service, including software, UI, branding, and proprietary analytics methodologies (excluding User Content and third-party marks).
You may not copy, modify, distribute, sell, lease, or create derivative works of the Service except as expressly permitted.
9) Confidentiality
Non-public information shared through the Service (e.g., campaign plans, pricing, internal notes) should be treated as confidential. You agree not to disclose confidential information without authorization.
10) Suspension & Termination
We may suspend or terminate your account immediately if:
you breach these Terms,
your use creates risk for the Service, other users, or third parties,
required by law or valid legal process,
or for non-payment.
You may cancel anytime through your account settings (access remains until the end of the paid billing period unless otherwise stated).
11) Disclaimers
The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant uninterrupted operation, error-free performance, or that the Service will meet every requirement.
12) Limitation of Liability
To the maximum extent permitted by law:
Hypebox will not be liable for indirect, incidental, special, consequential, or punitive damages.
Our total liability for any claim relating to the Service will not exceed the amount you paid to us in the [three] months preceding the event giving rise to the claim (or USD 10 if you have not paid).
Some jurisdictions do not allow certain limitations, so parts may not apply to you.
13) Indemnification
You agree to indemnify and hold harmless Hypebox from claims arising out of:
your use of the Service,
your User Content,
your misuse of Scraped Data,
your violation of law, platform terms, or third-party rights.
14) Governing Law & Dispute Resolution

“Scraped Data” means Public Web Data that is collected or retrieved by the Service (directly or via our infrastructure/vendors) and then displayed, analyzed, or stored as part of the Service.

We do not intend to:

We may restrict features, block targets, or suspend accounts to enforce these Terms and protect the Service.
6.5 Accuracy & “As-Is” Nature of Public Data
Public Web Data can change frequently, be incomplete, or be inaccurate. We do not guarantee accuracy, completeness, or timeliness of Scraped Data or analytics outputs. You should independently verify critical information before acting on it.
6.6 Rights Requests / Takedown (Creators & Third Parties)
If you are a creator or rights holder and believe the Service displays inaccurate public information, or you have a lawful request related to your data:

We will review requests and take appropriate action where required by law.
6.7 Third-Party Infrastructure (Apify / Bright Data and Similar)
To operate the Service, we may use reputable third-party providers for web-data automation, routing, proxies, and related infrastructure (for example, Apify and Bright Data).
These providers generally require customers to comply with law and their acceptable use policies, and they emphasize responsible public-data collection practices.
Important: Even if we use third-party infrastructure, you remain responsible for ensuring your specific use case is lawful and compliant.
7) User Content & Inputs
